Was Zborowski convicted in relation to a patient's death?

Not in the final judgment. The Supreme Court, in case III KK 461/22, held that the factual basis included the finding that Monika K. made her own voluntary and independent decision not to undergo conventional oncological treatment. The Court stated that Zborowski had no influence on that decision and analysed why the consequences associated with her illness could not be attributed to him under Articles 160 §1 and 155 on the basis used by the earlier courts. The Supreme Court overturned the earlier appellate judgment and returned the case for reconsideration, leaving the separate issue of possible fraud liability under Article 286 to be examined. The final judgment of 30 November 2023, IV Ka 1635/23, did not convict Zborowski under Article 155 for negligent homicide or Article 160 §1 for exposure to danger. The offence ultimately attributed was under Article 286 §1 in conjunction with Article 12 and concerned PLN 1,920. The court imposed 10 months' imprisonment with the earlier conditional suspension applied and revoked previously imposed penal and compensatory measures. The accurate summary is: the earlier death- and danger-related findings did not remain in the final attributed offence; the final conviction concerned fraud involving PLN 1,920.
